Susan Rambles: Humanistic Mediation. A Preferred Victim-Offender Conflict Resolution Technique
Humanistic Mediation is a unique style of mediation that includes spirituality, compassionate strength, and a focus on our basic human needs and connection. Not only is it an effective model of conflict resolution, it can bring a greater sense of community and social harmony.
In all of the conflict resolution techniques that I have studied, I feel this style most aligns with my own values and beliefs:
Belief in the connection of all things and our common humanity
Belief in the desire of most people to live peacefully
Belief in the desire of most people to grow through life experiences.
For over four decades, I have had extensive experiences as a healer: Energy healer, shaman, massage therapist, and nurse. From these experiences, I have a deep feeling that we as humans have an innate wisdom to know how to heal ourselves. Many of us in our culture have not been exposed to this kind of idea nor the healing techniques that could be helpful in this process. I feel the Victim-Offender Mediation is one bridge that can span the gap between wanting to heal and knowing how to get there. A good healer/humanist mediator can set the stage of support and safety that is imperative for healing.
Genuine dialogue (including quiet moments) in a safe space where people are able to speak and listen in a non defensive way takes skills and practice. This whole concept I find to be rather unknown in the thinking of my western culture (western united states).
The Victim-Offender Conflict Resolution process provides a forum for reconciliation between those who have received harm and those who have caused the harm. This process could also include family and community members. Everyone meets and talks in a safe, respectful, and constructive environment. These interactions are facilitated by trained mediators. Focuses and outcomes include:
Reveals the effects the harm has caused the individual, family, and/or community
Cases can range from non-violent to violent offenses which could include misdemeanors to felonies
Promotes the healing process for survivors and victims
Encourages accountability of the person(s) who caused the harm
Creates a space where the victim and offender can speak face to face, which can lead to authentic conversation and sharing of emotions
The story can be told and heard
Creates support and validation
Offers an opportunity of having a say in how the offender will rectify the situation
Gives the offender the chance to make things right
Provides the perpetrator a better change to reintegrate into community life. This in turn, benefits the community by lowering recidivism, improving public safety, and community building
Allows all parties the possibility of moving on with their lives with a new sense of empowerment and promise
